Settlement Law

The Settlement Law is the legal framework in Turkey that governs residential settlements and relocation, outlining the principles for migration, compulsory settlement, and state policies on relocation. Law No. 2510 on Settlement aims to organize the economic, social, and demographic structure of the country, guiding migration, forced settlement, and the government’s settlement policies.

Key Principles of the Settlement Law

  1. Migration and Relocation: The Settlement Law includes the principles for settling people who are forced to migrate within national borders, with the process managed by the state. Settlement policies have been developed to help migrants or people moving to new areas as part of internal migration to integrate with society. The government arranges locations, housing, and the provision of basic needs for migrants.
  2. Settlement Zones and Living Arrangements: The law regulates the declaration of certain areas as settlement zones and defines who can be resettled in these areas. The infrastructure and other necessary amenities of new settlement areas are provided by the state, ensuring that individuals in these regions integrate effectively with society.
  3. State Assistance and Incentives: Under the Settlement Law, those resettled may receive various forms of assistance from the government. These benefits include support for building housing, incentives for agricultural or livestock activities, and low-interest loans. Access to education and health services is also provided to support the social integration of resettled individuals.
  4. Compulsory Settlement and Security Measures: For reasons such as public security or order, the state may decide to relocate people from a specific region to another area. In such cases, the basic needs of resettled people, including housing, education, and social services, are addressed by the state.

5.  Relocation and Compensation Rights: The law also includes provisions for compensation and relocation for individuals who are compulsorily resettled. In these cases, relocated individuals are granted certain financial support by the government and receive assistance to help them continue their lives in new locations.

The Settlement Law and Recent Amendments

Due to demographic changes, natural disasters, and security concerns in Turkey, the Settlement Law undergoes occasional updates. New regulations aim to enhance the efficiency of relocation, migrant resettlement, and integration processes.
