Turkish Citizenship Law

The Turkish Citizenship Law governs the acquisition, loss, and procedures related to Turkish nationality. It provides the legal framework for Turkish citizenship by birth, descent, naturalization, marriage, and investment, among other avenues. Law No. 5901 on Turkish Citizenship is the primary legislation regulating these areas, alongside relevant regulations and presidential decrees.

Key Provisions of Turkish Citizenship Law

  1. Citizenship by Birth: Turkish citizenship is automatically granted to those born to a Turkish mother or father, regardless of the place of birth. This right follows the principle of jus sanguinis, or “right of blood,” meaning that a child inherits nationality through parentage rather than birthplace.
  2. Citizenship by Descent: Individuals born outside Turkey to Turkish parents can acquire Turkish citizenship by descent. If either parent is a Turkish national, the individual is eligible for Turkish citizenship, which may require a formal application if the descent is claimed after birth registration.
  3. Citizenship by Marriage: Foreign nationals who marry Turkish citizens may apply for Turkish citizenship after three years of marriage. The application process includes assessments to confirm the authenticity of the marriage and verify that the couple has established a genuine family life together. However, marriage to a Turkish citizen does not automatically grant citizenship.
  4. Citizenship by Naturalization: Foreign nationals who meet certain residency and eligibility criteria may apply for Turkish citizenship through naturalization. Requirements include a minimum of five years of residence in Turkey, demonstrating sufficient knowledge of Turkish, and proof of good moral character. Applicants must also have stable income or employment.
  5. Citizenship by Investment: Turkey offers a Citizenship by Investment program, which enables foreign investors to obtain Turkish citizenship by making a qualifying investment. This may include purchasing real estate valued at a minimum of USD 400,000, creating jobs for at least 50 people, or making capital contributions as specified under the latest legal requirements. This program allows for an expedited application process.
  6. Loss of Citizenship: Turkish Citizenship Law also outlines conditions under which Turkish citizenship may be revoked, such as voluntary acquisition of a foreign nationality without following the dual citizenship rules or involvement in activities that threaten national security.

7.  Dual Citizenship: Turkey allows dual citizenship, although some restrictions apply. Turkish citizens who acquire a second nationality should inform Turkish authorities, and some countries may require Turkish nationals to renounce their Turkish citizenship to comply with their laws.

Application Process for Turkish Citizenship

Applications for Turkish citizenship typically involve submitting essential documents, attending interviews, and undergoing background checks to confirm eligibility. The process varies based on the method of acquisition and the applicant’s circumstances. The General Directorate of Civil Registration and Nationality under the Ministry of Interior handles citizenship applications.
